1Short title

This regulation may be cited as the Surveyors Regulation 2014 .

2Criteria for registration as an emeritus surveyor

(1)For section 36 (3) (c) of the Act, the prescribed criteria are—
(a)the individual has been registered as a surveyor—
(i)for at least 25 consecutive years; or
(ii)for periods the board is satisfied are at least equivalent to being registered for 25 consecutive years; and
(b)the individual has given the board a written statement notifying the board that the individual has retired from surveying practice.
(2)It is a further prescribed criterion that if the individual is the cadastral surveyor responsible for the survey quality of a relevant plan of survey, the individual must have—
(a)authorised another person to take the action mentioned in the Survey and Mapping Infrastructure Act 2003 , section 32 (1) for the survey; and
(b)given the board a copy of the authorisation.
(3)In this section—
registered means registered as a surveyor under the Act, the repealed Act or a corresponding law.
relevant plan of survey means a plan of survey that—
(a)is to be registered under the Land Act 1994 or Land Title Act 1994 ; or
(b)is required for a purpose under the Mineral Resources Act 1989 .

3Insurance coverage

For sections 36 (2) (c) (ii) (A) and 38 (2) (c) of the Act, the following insurance cover is prescribed—
(a)for an individual—professional indemnity insurance for at least $1m;
(b)for a corporation—professional indemnity insurance for at least $1m.

4Application for competency assessment—Act, s 44(2)

An application for assessment under section 44 of the Act must be made in the approved form and be accompanied by the documents identified in the form.

5Particulars for register

(1)For section 68 (3) of the Act, the following particulars are prescribed—
(a)the registrant’s name;
(b)the registrant’s address (including business and postal addresses);
(c)the type of registration held by the registrant;
(d)the day the registrant was first registered for the registrant’s current type of registration under the Act, the repealed Act or a corresponding law;
(e)the day the registrant’s registration expires;
(f)the registration endorsements held by the registrant;
(g)the day any registration endorsements held by the registrant expire;
(h)if the registrant is a corporation and intends to conduct, or holds itself out as conducting, cadastral surveys—the name of a cadastral surveyor employed by the corporation;
(i)if the registrant is a corporation and holds a registration endorsement (other than a registration endorsement for cadastral surveys or as a consulting surveyor)—the name of a surveyor who is employed by the corporation and holds the same registration endorsement;
(j)if the registrant is a corporation and paragraphs (h) and (i) do not apply—the name of a surveyor employed by the corporation;
(k)if a professional conduct review panel takes disciplinary action against the registrant under section 91 of the Act—details of the action;
(l)if QCAT takes disciplinary action against the registrant—details of the action, other than the details mentioned in section 127 (2) of the Act.
(2)For subsection (1) (k) and (l), the details must be included in the publicly available part of the register for the following period—
(a)if conditions are imposed on the registrant’s registration, registration endorsement or re-application for registration—the period the conditions are in force;
(b)if a professional conduct review panel or QCAT decides disciplinary action taken against the registrant must be included in the publicly available part of the register for a period—the stated period.

6Notice of change in circumstances

For section 72 of the Act, the following changes in circumstance are prescribed—
(a)the registrant’s name;
(b)the registrant’s address (including business and postal addresses);
(c)a registration endorsement held by the registrant;
(d)for a corporation that intends to conduct, or holds itself out as conducting, cadastral surveys—the cadastral surveyor named in section 5 (1) (h);
(e)for a corporation that holds a registration endorsement (other than a registration endorsement for cadastral surveys or as a consulting surveyor)—the surveyor named in section 5 (1) (i);
(f)for a corporation, other than a corporation mentioned in paragraph (d) or (e)—the surveyor named in section 5 (1) (j).

7Title for holder of registration endorsement for cadastral surveys—Act, s 192(2)(b)

A surveyor who holds a registration endorsement for carrying out cadastral surveys may use the title ‘registered surveyor—land’ to show the type of registration endorsement held by the surveyor.

8Fees

The fees payable under the Act are stated in schedule 1.

9Repeal

The Surveyors Regulation 2004, SL No. 128 is repealed.
