This notice may be cited as the Superannuation (State Public Sector) Notice 2010 .
This notice commences on 30 August 2010.
In this notice—1972 Act means the repealed State Service Superannuation Act 1972 .1972 officer means a person who would be an officer within the meaning given by the 1972 Act if that Act had not been repealed.1974 Act means the repealed Police Superannuation Act 1974 .1974 member means a person who would be a member within the meaning given by the 1974 Act if that Act had not been repealed.ARG-QR means the following—(a)Australia Eastern Railroad Pty Ltd ACN 118 274 776;(b)Australian Railroad Group Employment Pty Ltd ACN 087 891 601;(c)Australia Western Railroad Pty Ltd ACN 094 792 275;(d)AWR Lease Co Pty Ltd ACN 094 792 159.casual employee means an employee who, under the terms of his or her employment, is not entitled to annual leave, sick leave or payment for a public holiday.CHQHHS means Children’s Health Queensland Hospital and Health Service.def CHQHHS ins 2014 SL No. 206 s 3
contract employee means an employee employed under an individual contract of employment.LCCH establishment measure means either of the following—(a)the Queensland Government’s Lady Cilento Children’s Hospital Workforce Establishment Strategy as in force on 20 February 2014;(b)tier 2 of the CHQHHS organisational structure as in force on 9 September 2013.def LCCH establishment measure ins 2014 SL No. 206 s 3

police recruit means a person who holds a position in the Queensland Police Service as a police recruit.QFS superannuation scheme means the superannuation scheme that, immediately before the commencement of the Superannuation and Other Legislation Amendment Act 1997 , part 6, was operated under the Fire and Rescue Service Act 1990 .def QFS Superannuation scheme amd 2014 Act No. 17s 184sch1 pt 4

QRN transfer day means the day beneficial ownership of a share in QR National Limited ACN 146 335 622 is first transferred from the State to another person.def QRN transfer day ins 2010 SL No. 316 s 3
Queensland Fire Service means the Queensland Fire Service established under the Fire and Rescue Authority Act 1990 before the commencement of the Fire Service Amendment Act 1996 , section 8.The short title of the Fire and Rescue Service Act 1990 was amended by the Public Safety Business Agency Act 2014 and is now the Fire and Emergency Services Act 1990 .def Queensland Fire Service amd 2014 Act No. 17 s 184 sch 1 pt 4
retrospective eligibility period see section 16 (2).standard compulsory rate see section 5 (2).temporary employee means a non-casual employee who is employed for a period limited by time, whether or not the time has been fixed.
A reference in this notice to a category is a reference to the membership category of that name established under the deed.See section 22 of the deed.
5Standard compulsory rate for certain members
(1)This notice states the standard compulsory rate applying to a member in the standard defined benefit category, comprehensive accumulation category or QAS accumulation category as a condition of membership in the category.(2)The standard compulsory rate is the rate at which the member must make contributions to the scheme, under the deed, if the member has not elected under the deed to make contributions at a different rate.(3)Unless the schedule states otherwise, the standard compulsory rate for the member is 5%.
(1)This section applies to an employee’s membership in the basic accumulation, comprehensive accumulation or QAS accumulation category.(2)Amounts held for the employee in the scheme must be applied towards prescribed insurance for the employee under the deed, unless the employee elects, under the deed, not to have the insurance.(3)In this section—prescribed insurance means—(a)for a non-casual employee whose membership is in the QAS accumulation category—long-term salary protection insurance and insurance in case of death; or(b)for another non-casual employee—income protection insurance and insurance in case of death or total and permanent disablement; or(c)for a casual employee whose membership is in the QAS accumulation category—insurance in case of death; or(d)for another casual employee—insurance in case of death or total and permanent disablement.
(1)This section applies to a unit of the State public sector mentioned in the schedule.(2)The schedule states the following—(a)the employees of the unit who are eligible for membership of the scheme;(b)for each of the employees—(i)whether membership is compulsory or discretionary; and(ii)the membership category or categories for which the employee is eligible; and(iii)any conditions applying to membership.(3)This section applies subject to sections 8 to 10 and 15.
If an employee mentioned in the schedule receives a salary of less than $450 a month for particular employment, the employee is ineligible for membership of the scheme for the employment.s 8 sub 2015 SL No. 76 s 3
(1)This section applies to a person who is an employee of a unit of the State public sector and for whom membership of the scheme is, under the schedule, discretionary.(2)The person may, at any time while the person is an employee of the unit of the State public sector, decide to become a member of the scheme.(3)If the person decides to become a member of the scheme, the person must, while the person continues to be an employee of the unit of the State public sector, continue to be a member of the scheme.
10Restriction for eligibility in QAS accumulation category
If a member in the QAS accumulation category becomes a member in another category, the member is ineligible for membership in the QAS accumulation category.
11Particular persons eligible for membership
(1)This section applies to a person in the person’s capacity as—(a)the spouse of a member of the scheme; or(b)an entitled former spouse.(2)This section also applies to a person for whom an amount is paid to the fund under any of the following—(a)the Governors (Salary and Pensions) Act 2003 , section 16C;(b)the Judges (Pensions and Long Leave) Act 1957 , section 11.(3)The person is eligible for membership of the scheme.(4)Membership by the person is discretionary.(5)The person is eligible for membership in the basic accumulation category.(6)In this section—entitled former spouse means a person who is entitled or conditionally entitled, under an agreement under the Family Law Act 1975 (Cwlth) or a court order under that Act, to payment of an amount from the fund.
12Discretionary membership for officer in State 72 category
(1)This section applies if a person who is a member in the State 72 category—(a)ceases to be a 1972 officer; and(b)within 1 month after ceasing, again becomes a 1972 officer.(2)The person is eligible for membership in the State 72 category until 3 months after the time the person again became a 1972 officer.
13Discretionary membership for contributor in State 72 category
(1)This section applies if a person who is a member in the State 72 category—(a)ceases to be a 1972 officer; and(b)made an election under section 35 (2) of the 1972 Act before the repeal of that Act or makes an election under section 191 (2) of the deed; and(c)again becomes a 1972 officer.(2)The person is eligible for membership in the State 72 category until 3 months after the time the person again became a 1972 officer.
14Discretionary membership for contributor in police 74 category
(1)This section applies if a person who is a member in the police 74 category—(a)ceases to be a 1974 member; and(b)made an election under section 33 (2) of the 1974 Act before the repeal of that Act or makes an election under section 299 (2) of the deed; and(c)again becomes a 1974 member.(2)The person is eligible for membership in the police 74 category until 3 months after the time the person again became a 1974 member.
15Excepted persons—Act, s 13(4)
(1)The following persons are excepted from the Act—(a)a person who—(i)is an employee of a unit of the State public sector while on leave from other employment; and(ii)continues as a member of a superannuation scheme operated for the other employment and to which the State has agreed to contribute as the person’s employer;(b)a person who—(i)is employed under a contract with a unit of the State public sector that is entirely or mainly for the person’s labour; and(ii)is a member of a superannuation scheme approved by the Minister under subsection (2);(c)a person who—(i)is employed by a unit of the State public sector in, or to perform the duties of, an office or other position under a law of the State; and(ii)is a member of a superannuation scheme approved by the Minister under subsection (2);(d)an employee of a prescribed university who—(i)became a member of the scheme between 1 January 1991 and 30 June 1991; and(ii)between 1 July 1991 and 31 December 1991, elected to become a member of the Superannuation Scheme for Australian Universities;(e)an employee of a prescribed university who—(i)started the employment on or after 1 July 1991; and(ii)is not, on the commencement of this section, a member of the scheme for the employment;(f)a judge of the Supreme Court of Queensland or the District Court;(g)a member of the Land Court or the Queensland Industrial Relations Commission to whom the Judges (Pensions and Long Leave) Act 1957 applies;(h)the chairman of the Crime and Corruption Commission;(i)an officer of the Legal Aid Commission who is a contributor to the Commonwealth Superannuation Scheme established under the Superannuation Act 1976 (Cwlth);(j)an employee of QIC Ltd ACN 130 539 123, or QIC Private Capital Pty Ltd ACN 076 279 528, if—(i)the employee has elected not to be a member of the scheme by notice in writing to the employee’s employer; and(ii)the employee has given a copy of the written notice to the board; and(iii)the employee has not revoked the election by notice in writing to the employee’s employer.(2)The Minister may approve a superannuation scheme for subsection (1) (b) or (c) if the Minister is satisfied the scheme—(a)provides appropriate superannuation to satisfy the employer’s obligations; and(b)meets standards set for the management of superannuation funds under a law of the Commonwealth.(4)In this section—prescribed university means either of the following—(a)Queensland University of Technology;(b)James Cook University of North Queensland.s 15 amd 2012 SL No. 95 s 3; 2014 SL No. 206 s 4; 2015 Act No. 2 s 58
16Matters relating to retrospective eligibility
(1)This section applies to a person mentioned in the schedule, column 6, who was employed before the declaration day by the unit of the State public sector mentioned opposite in the schedule.(2)The person is taken to have been eligible for membership of the scheme for the period of the person’s employment, before the declaration day, stated in column 6 (the retrospective eligibility period).(3)The person’s eligibility for the retrospective eligibility period is taken to be the eligibility stated in the schedule, on the declaration day, for the equivalent employment.(4)To remove any doubt, it is declared that a person’s membership for the retrospective eligibility period is discretionary.(5)A person’s eligibility under this section is subject to any condition stated in the schedule, column 6.(6)In this section—condition includes—(a)a condition that a person was employed by a stated entity at or for a stated time; and(b)a condition that a person’s eligibility is subject to the approval of the person’s employer.declaration day, for a person, means the day of the commencement of the declaration in this notice—(a)that the person is eligible for membership of the scheme; or(b)that a member of a stated class, of which the person was a member, is eligible for membership of the scheme.s 16 amd 2013 SL No. 179 s 3
The Superannuation (State Public Sector) Notice 2000, SL No. 79 is repealed.
18Continued application of repealed s 16
The repealed Superannuation (State Public Sector) Notice 2000 , section 16, as in force immediately before the commencement of this section, continues to apply.
19Certain former Queensland Manufactured Water Authority employees not eligible for membership
(1)This section applies to an employee of Queensland Manufactured Water Authority who became an employee of Queensland Bulk Water Supply Authority on the transfer day under the South East Queensland Water (Restructuring) Regulation 2011 .(2)If the employee was not eligible for membership of the scheme immediately before the transfer day, the employee is taken to be not eligible for membership of the scheme on or after the transfer day.(3)In this section—transfer day see the South East Queensland Water (Restructuring) Regulation 2011 , schedule.s 19 ins 2011 SL No. 294 s 3
