An Act to amend the Mineral Resources Act 1989 to stop coal mining in the Galilee Basin
The Parliament of Queensland enacts—
This Act may be cited as the Mineral Resources (Galilee Basin) Amendment Act 2018.
This Act amends the Mineral Resources Act 1989.
3Amendment of s 234 (Minister may grant mining lease)
Section 234—
insert—(4)In addition, the Minister must not grant a coal mining lease for land in the Galilee Basin.(5)Subsection (4) applies to an application for a mining lease whether the application was made before or after the commencement of that subsection.(6)In this section—coal mining lease means—(a)a mining lease for coal; or(b)a specific purpose mining lease for a purpose associated with, arising from or promoting the activity of coal mining, whether or not it is also granted for a purpose other than coal mining.Galilee Basin means the region in western central Queensland identified in figure 3 of the document called ‘Queensland coal – mines and advanced projects’ dated July 2017.A copy of the document can be viewed at https://www.dnrm.qld.gov.au/__data/assets/pdf_file/0011/238079/coal-mines-advanced-projects.pdf.

Chapter 12—

(1)This section applies to a coal mining lease that is only for land in the Galilee Basin.(2)On the commencement, the coal mining lease is terminated.(3)Sections 312, 313, 314 and 318 apply in relation to the termination of the coal mining lease.(4)No compensation is payable for the termination of the coal mining lease.334ZJN Amendment of existing coal mining leases over land that includes land in the Galilee Basin
(1)This section applies to a coal mining lease for land, only part of which is in the Galilee Basin.(2)The Minister must, as soon as practicable after the commencement, amend the lease so that the amended lease is no longer for any land in the Galilee Basin.(3)Section 295 applies to the amendment of the coal mining lease as if—(a)section 295(1) included a reference to an amendment mentioned in subsection (2); and(b)a reference in that section to a variation of a mining lease were a reference to the amendment of the coal mining lease.(4)No compensation is payable for the amendment of the coal mining lease.334ZJO Minister must table report
The Minister must, within 3 months after the commencement, table in the Legislative Assembly a report summarising the actions taken by the Minister under this part and identifying the coal mining leases affected by the actions.

Schedule 2, definition coal mining lease—
omit, insert—coal mining lease—(a)for chapter 12, part 4C—see section 334ZJL; or(b)generally—see section 318AE(2).
