1Short title

This regulation may be cited as the Economic Development and Other Legislation (Waraba PDA) Amendment Regulation 2024.

2Regulation amended

This part amends the Economic Development Regulation 2023.

3Insertion of new 3A

After section 3
insert—

3AExpiry date for interim land use plan for Waraba priority development area—Act, s 37

For section 37(3)(a) of the Act, the expiry date for the interim land use plan for the Waraba priority development area is 2 August 2026.

See also section 40AB of the Act in relation to the expiry of an interim land use plan for a priority development area.

This part amends the Planning Regulation 2017.

6Amendment of sch 10, s 3A (Prohibited development—development in Caboolture West investigation area)

(1)Schedule 10, section 3A(2)(a), after ‘instrument’—
insert—

in effect immediately before the Waraba priority development area was declared

(2)Schedule 10, section 3A(2)—
insert—
(g)is Waraba PDA-related development.
(3)Schedule 10, section 3A(3)—
insert—
prohibition period means the period starting on 27 July 2022 and ending on 13 March 2023.
Waraba PDA-related development
(a)means development in the Waraba priority development area or PDA-associated development for the Waraba priority development area; but
(b)does not include development the subject of a development approval given for an application made during the prohibition period.

7Amendment of sch 10, s 3B (Prohibited development—particular development in Caboolture West growth area)

(1)Schedule 10, section 3B(2)—
insert—
(e)is Waraba PDA-related development.
(2)Schedule 10, section 3B

(3)In this section—
Waraba PDA-related development
(a)means development in the Waraba priority development area or PDA-associated development for the Waraba priority development area; but
(b)does not include development the subject of an application properly made before the Waraba priority development area was declared.

8Amendment of sch 10, s 3C (Assessable development—particular operational work in Caboolture West growth area)

Schedule 10, section 3C
insert—
(2)However, subsection (1) does not apply to the extent the development is PDA assessable development for the Waraba priority development area.

PDA assessable development see the Economic Development Act, section 33(3).
