This rule may be cited as the Planning and Environment Court Amendment Rule 2024.
This rule commences immediately after the commencement of the Uniform Civil Procedure (Fees) and Other Legislation Amendment Regulation 2024, section 30.
This rule amends the Planning and Environment Court Rules 2018.

insert—47ARelationship with Uniform Civil Procedure Rules 1999
The Uniform Civil Procedure Rules 1999, chapter 22, part 1, division 6 does not apply in relation to a document filed in a P&E Court proceeding.(1)A person may ask a registrar for a copy or certified copy of a document filed in a P&E Court proceeding.(2)The person making the request must pay any prescribed fee for the copy or certified copy of the document.(3)Subject to any court order restricting access to the file or document, the registrar must give the person a copy or certified copy of the document as the case may be.(4)The copy of the document must have the seal and the word ‘copy’ stamped on it.(1)A person may ask a registrar to search for, and allow the person to inspect, a document filed in a P&E Court proceeding.(2)If the person making the request is not a party, or a representative of a party, to the proceeding in which the document was filed, the person must pay any prescribed fee for the search or inspection.(3)Subject to any court order restricting access to the file or document, or the file or document being required for the court’s use, the registrar must comply with the request, unless there is not enough information for the registrar to be able to comply with the request.(4)The registrar may, on payment of the prescribed fee, issue a certificate of the result of the search for the document.
