Fisheries (Coral) Amendment Declaration 2022

1Short title

This declaration may be cited as the Fisheries (Coral) Amendment Declaration 2022.

2Commencement

This declaration commences on 1 July 2022.

3Declaration amended

This declaration amends the Fisheries Declaration 2019.

4Amendment of s 4 (Relationship between fisheries declarations)

(1)Section 4, heading, ‘Relationship between’—
omit, insert—

Application of

(2)Section 4, before subsection (1)—
insert—

(1AA)A prohibition or restriction on the carrying out of an activity under a fisheries declaration applies to persons acting under an authority.

6Amendment of sch 2 (Regulated fish declarations)

Schedule 2, part 2, before entry for a regulated coral reef fin fish—
insert—

regulated coral			if the prescribed commercial catch for the fish is more than the weight stated for the fish in schedule 2A—a person taking or possessing the fish while acting under a licence on which is written the fishery symbol ‘D’
coral of the order Scleractinia, the family Tubiporidae or the family Stylasteridae, that is not— (a)  regulated coral; or (b)  live rock or coral rubble			a person taking or possessing the fish for trade or commerce
coral of the order Antipatharia or the family Milleporidae			a person taking or possessing the fish for trade or commerce
