1Short title

This declaration may be cited as the Fisheries Legislation Amendment Declaration 2021.

2Commencement

(1)Part 2, division 2 commences on 1 July 2021.

(2)Part 2, division 3 and part 3, division 2 commence on 1 September 2021 immediately after the commencement of the Fisheries Legislation Amendment Regulation 2020, chapter 4.

(3)Part 2, division 4 commences on 1 January 2022.

(4)Part 3, division 3 commences on 1 July 2022.

(1)This section applies in relation to the prescribed commercial catch for a species of fish mentioned in the following provisions of schedule 2, part 2—

(a)entry for dusky flathead, first row;

(b)entry for hammerhead shark, fifth row;

(c)entry for school mackerel, first row;

(d)entry for sea mullet, first row;

(e)entry for shark or ray (other than manta ray, sandtiger shark, speartooth shark or white shark), fifth row;

(f)entry for spotted mackerel, first row;

(g)entry for tailor, third row;

(h)entry for yellowfin bream, first row.

(2)The prescribed commercial catch is the total weight of fish of the species taken under all relevant licences for the fish that is—

(a)calculated periodically by the chief executive from the commencement to the day the calculation is made; and

(b)published on the department’s website and in any other form the chief executive considers appropriate.

Example of another form of publication for paragraph (b)—

(3)Subsection (2) applies—

4Total quota entitlements

(1)The total quota entitlement for a commercial fishery, or a part of a commercial fishery, mentioned in schedule 1 for fish mentioned in column 1 of the schedule is the amount stated opposite the fish in column 2.

(2)The total quota entitlement applies to—

(a)for fish taken in the commercial trawl fishery (fin fish)—each calendar year; or

(b)for fish taken in another commercial fishery or a part of another commercial fishery—each quota year, as defined in the Fisheries (Commercial Fisheries) Regulation 2019, section 107, for the quota authority authorising the taking of the fish in the fishery or the part of the fishery.

(3)A reference to a part of a commercial fishery in schedule 1 by name is a reference to the part of the fishery of that name described in a fishery provision about the fishery.
