Nature Conservation (Protected Areas Management) and Other Legislation Amendment Regulation 2019

1Short title

This regulation may be cited as the Nature Conservation (Protected Areas Management) and Other Legislation Amendment Regulation 2019.

2Regulation amended

This part amends the Nature Conservation (Protected Areas Management) Regulation 2017.

3Amendment of s 128 (Unauthorised feeding of animals)

(1)Section 128(1), penalty—
omit, insert—

Maximum penalty—

(a)if the animal is a dingo (Canis familiaris dingo) and the offence is committed on Fraser Island—80 penalty units; or

(b)otherwise—40 penalty units.

(2)Section 128(2), penalty—
omit, insert—

Maximum penalty—

(a)if the animal is a dingo (Canis familiaris dingo) and the offence is committed on Fraser Island—80 penalty units; or

(b)otherwise—40 penalty units.

4Amendment of s 130 (Unauthorised disturbance of animals)

Section 130(1), penalty—
omit, insert—

Maximum penalty—

(a)if the animal is a dingo (Canis familiaris dingo) and the offence is committed on Fraser Island—80 penalty units; or

(b)otherwise—40 penalty units.

5Regulation amended

This part amends the Nature Conservation (Wildlife Management) Regulation 2006.

6Amendment of s 341 (Feeding dangerous native animals in the wild)

Section 341(1), penalty—
omit, insert—

Maximum penalty—

(a)if the native animal is a dingo (Canis familiaris dingo) and the offence is committed on Fraser Island—80 penalty units; or

(b)otherwise—40 penalty units.

7Amendment of s 342 (Disturbing dangerous native animals in the wild)

Section 342(1), penalty—
omit, insert—

Maximum penalty—

(a)if the native animal is a dingo (Canis familiaris dingo) and the offence is committed on Fraser Island—80 penalty units; or

(b)otherwise—40 penalty units.

8Regulation amended

This part amends the State Penalties Enforcement Regulation 2014.
