Health and Other Legislation (Nursing and Midwifery) Amendment Regulation 2018

1Short title

This regulation may be cited as the Health and Other Legislation (Nursing and Midwifery) Amendment Regulation 2018.

2Commencement

This regulation commences on 1 December 2018.

3Regulation amended

This part amends the Child Employment Regulation 2016.

4Amendment of sch 3 (Dictionary)

(1)Schedule 3, definition midwife—

omit, insert—

midwife means a person registered under the Health Practitioner Regulation National Law to practise in the midwifery profession, other than as a student.

(2)Schedule 3, definition registered nurse, paragraph (a)—

omit, insert—

(a)to practise in the nursing profession, other than as a student; and

This part amends the Child Protection (Offender Reporting and Offender Prohibition Order) Regulation 2015.

6Amendment of s 12 (Reports not made in person—Act, s 29(5))

Section 12(4), definition registered nurse, paragraph (a)—

omit, insert—

(a)to practise in the nursing profession, other than as a student; and

7Regulation amended

This part amends the Coal Mining Safety and Health Regulation 2017.

8Amendment of s 16 (Giving notice of incidents)

Section 16(3), definition nurse—

omit, insert—

nurse means a person registered under the Health Practitioner Regulation National Law to practise in the nursing profession, other than as a student.

9Regulation amended

This part amends the Health (Drugs and Poisons) Regulation 1996.

10Amendment of appendix 9 (Dictionary)

(1)Appendix 9, definition enrolled nurse, paragraph (a), ‘and midwifery’—

omit.

(2)Appendix 9, definition midwife—

omit, insert—

midwife means a person registered under the Health Practitioner Regulation National Law to practise in the midwifery profession, other than as a student.

(3)Appendix 9, definition registered nurse, paragraph (a), ‘and midwifery’—

omit.

11Regulation amended

This part amends the Private Health Facilities Regulation 2016.

12Amendment of s 5 (Prescribed change for which notice must be given)

Section 5(2), definition nurse, paragraph (a)—

omit, insert—

(a)to practise in the nursing profession, other than as a student; and

13Regulation amended

This part amends the Radiation Safety Regulation 2010.
