section 4 of the Act, this division prescribesthe requirements
for an enclosure and an area enclosed for arelevant
dog.8Public access to front entrance of
houseThe enclosure must not be built or situated
in a way requiringa member of the public seeking access to the
front entrance ofa dwelling house on the relevant place to go
into the enclosedarea.Note—Relevant placeis defined in
schedule 1, section 1 of the Act.9Minimum enclosed area(1)The
area enclosed must be at least 10m2.Note—SeealsotheAnimalCareandProtectionAct2001,section33(Obligation to exercise closely
confined dogs).(2)The area must not include any area
that is—(a)a swimming pool or area surrounding a
swimming pool;or(b)allorpartofabuildingusuallyusedforresidentialpurposes.10Minimum heightThe walls of the
enclosure must be—(a)if the dog is 8kg or less—at least 1m

conditions[s 11]11Standard for enclosure materialsThe
enclosure must consist of firm and strong materials.12Enclosure walls(1)The
exterior of the walls of the enclosure must be designed toprevent a child from climbing into the
enclosure.(2)The walls may include a perimeter
fence for the relevant placeoranexteriorwallofastructureifitcomplieswiththerequirements for the enclosure under
schedule 1, section 4 ofthe Act and this division.13Gate requirements(1)The
enclosure must include a gate (theenclosure
gate).(2)The enclosure
must not have a driveway gate or other vehicleentry gate
(avehicle gate).(3)The enclosure gate must—(a)be childproof, self-closing and
self-latching; and(b)complywiththerequirementsfortheenclosureunderschedule 1, section 4 of the Act and this
division.(4)However,theenclosuremayhaveanothergatethatisnotself-closing and
self-latching if it—(a)is not a vehicle
gate; and(b)complies with section 12; and(c)is kept securely locked whenever it is
not in immediateuse.14Weatherproof area

division—applicantsee section
24.approvalmeans an
approval that may be given by the chiefexecutive under
schedule 2 of the Act, definitionauthorisedimplanter.24Making
application(1)Aveterinarysurgeon(theapplicant)mayapplyforanapproval for a
course offered in a State or country as beingequivalent to a
course mentioned in section 20 or 22.(2)A
person other than a veterinary surgeon (also theapplicant)may
apply for an approval for any of the following offered ina
State or country—(a)aqualificationasbeingequivalenttoaqualificationmentioned in
section 21;(b)a course as being equivalent to a
course mentioned insection 22.(3)The
application must be—(a)made to the
chief executive in the approved form; and(b)supportedbyenoughinformationtoenablethechiefexecutive to
decide the application.25Chief executive
may ask for further information(1)The
chief executive may, by notice, require the applicant togiveotherinformationordocumentsreasonablyrequiredtoenable the chief executive to decide
the application.(2)The notice must state a reasonable
period of at least 14 days tocomply with the

stated in the notice, givethe chief executive the other
information or documents.(4)If subsection
(3) is not complied with, the application lapses.26Deciding application(1)Thechiefexecutivemustdecidetheapplicationwithin30days (therelevant
time) after the application is made.(2)However, if within the relevant time
the chief executive hasrequired the applicant to give other
information or documents(theother
information) under section 25, the chief
executivemustdecidetheapplicationwithin30daysaftertheotherinformation is
given to the chief executive.(3)Thechiefexecutivemayrefusetheapplicationifthechiefexecutive is
satisfied of any of the following—(a)iftheapplicantisaveterinarysurgeon—thecourseisnot equivalent to a course mentioned
in section 20 or 22;(b)if the applicant
is not a veterinary surgeon—(i)the
qualification is not equivalent to a qualificationmentioned in section 21; or(ii)the course is
not equivalent to a course mentionedin section
22;(c)theapplicanthascontravenedaprovisionofPIDlegislation;(d)theapplicanthashadanotherapprovalunderPIDlegislation cancelled or suspended.(4)In this section—PID
legislationmeans—(a)a
provision of the Act about the permanent identificationof
animals; or(b)a corresponding law that provides, or
provided, for thesame, or substantially the same, matter as a
provision ofthe Act about the permanent identification

of approval on conditionsThe chief executive may grant the
application on conditionsthe chief executive considers
reasonable and relevant.28Notice of
approval if application granted(1)Ifthechiefexecutivedecidestheapplication,thechiefexecutive must
give the applicant notice of the granting of theapproval within 30 days after making the
decision.(2)The notice must include—(a)detailsidentifyingtheapplicantandthecourseorqualification to which the approval relates;
and(b)anyconditiontowhichtheapprovalissubjectundersection 27; and(c)if
the conditions are conditions to which the applicanthasnotagreedinwriting—themattersmentionedinsection 29(2)(b).29Notice of refusal(1)Ifthechiefexecutivedecidestorefusetheapplication,thechief executive must give the applicant a
notice of the refusalwithin 30 days after making the
decision.(2)The notice must state—(a)the decision and the reasons for it;
and(b)that the applicant may apply for an
internal review of thedecision to the original decider for
the decision within14 days after the applicant receives the
notice; and(c)how to apply for the internal

from 1 October 2009, a keeper of a local law dangerousdog
mentioned in subsection (1)(a) continues to comply withthelocallawenclosurematerialsrequirement,thedog’senclosure is
taken to comply with section 11 until the earlierof
the following—(a)the keeper stops complying with the
requirement;(b)the dog dies.(4)In
this section—locallawenclosurematerialsrequirementmeansarequirement under a local law, or
resolution, of the relevantlocalgovernmentforalocallawdangerousdogforthestandard of
enclosure materials for local law dangerous dogsthat
is the same as, or similar to, repealed part 16, section 86in
force immediately before 1 July 2009.43Enclosure walls—deferred application of s 12
for keepers(1)This section applies to—(a)if a local law enclosure walls

taken to comply with section 14 until the earlierof
the following—(a)the keeper stops complying with the
requirement;(b)the dog dies.(4)In
this section—locallawweatherproofarearequirementmeansarequirement under a local law, or
resolution, of the relevantlocalgovernmentforalocallawdangerousdogforaweatherproof
sleeping area for local law dangerous dogs thatis the same as,
or similar to, repealed part 16, section 89 inforce
